Pools and Spas
All residential pools and spas are legally required to have a childproof safety barrier to protect young children from entering a pool area unsupervised.
This applies to all pools and spas that are capable of containing a depth of more than 30cm of water, irrespective of when they were installed.
The safety barriers must have self-closing gates, which must be fitted with self-latching devices that are located at least 1.5 metres above the ground.
A building permit is required prior to installing a pool or spa and safety barrier. A permit is also required prior to installing a safety barrier around an existing pool or spa.
Penalties of more than $5000 apply to property owners who fail to maintain a safety barrier.
